11 plead, sentenced for thefts, drug offenses

Circuit Court Judge Gina Groh and Judge Andrew Frye heard pleas and considered probation
status during open hearings in recent weeks.

John R. Schwartzbeck. Jr., 20, of Keystone Lane, Berkeley Springs, pled guilty to conspiracy to commit petit larceny and burglary with Nicholas J. Hoffman in May 2011. His sentencing was deferred until he completes a program at the Anthony Center for youthful offenders.

Shaylee R. Wills, 19, pled guilty to delivery of a controlled substance (heroin) in April 2011. Her sentence
of one-to-15 years was suspended for five years probation.

Andy McCauley, 34, of Berkeley Springs was sentenced to six months in the Eastern Regional Jail for destruction of property and six months for battery in May 2011. The sentences will run concurrently. McCauley must also pay $900 in restitution to his victims. A Morgan County jury found him guilty of the charges during a two-day trial in January.

Dustin Thomas, 20, of Great Cacapon pled guilty to delivery of a controlled substance (hydrocodone) in August 2011. His sentence of one-to-five years in jail was suspended for five years probation.

Michael T. Malone, 41, of Berkeley Springs pled guilty under Alford circumstances to domestic battery in the second degree, for an April 2011 incident involving his wife. His sentence of one year in jail was suspended for five years probation.

Charity D. Miller, 22, of Great Cacapon pled guilty to distribution of a controlled substance (oxycodone) in April 2011. Her sentence of one-to-15 years was suspended for five years probation.

Mark Taylor, 24, of Huron Trail, Berkeley Springs, pled guilty to petit larceny of a four-wheeler in June 2009. His sentence of one year in jail was suspended for one year supervised probation.

Joshua L. Grapes, 31, of Waynesboro, Pa. pled guilty to failure to pay child support for one child in 2008 and 2009 and failure to appear in court. His sentences of one year in jail for the child support offense and one-to-five years for the failure to appear charge were suspended for five years probation and four months in the Eastern Regional Jail, which he has already served.

Thomas E. Dusing, 31, of Debbie Terrace, Berkeley Springs pled no contest to destruction of property during an incident in August 2011. His sentence of up to one year in jail was suspended for two years probation and restitution.

Adam Ginevan, 35, of Lee Street, Paw Paw pled no contest to conspiracy with Janelle Kidwell to commit grand larceny for an incident in February 2011. His sentence of one-to-five years in jail was suspended for five years probation. Ginevan must also pay $6,100 in restitution to his victim with his conspirator.

Janelle L. Kidwell, 28, of Ewing Street, Berkeley Springs pled no contest to conspiring with Adam Ginevan to commit grand larceny in February 2011. Her sentence of one-to-five years in jail was suspended for five years probation. Kidwell, along with her conspirator, must pay $6,100 in restitution to her victim.

Probation revoked
The court revoked probation for Pam Cobb, 42, of Great Cacapon. Cobb was returned to jail, but the court deferred a decision about her original sentence of one-to-15 years for delivery of a controlled substance, pending completion of a drug assessment.

Michael Vaughan, 27, of Baltimore must return to prison to serve his original two-to-10 year sentence for malicious assault and battery, after his probation was revoked.

Probation for Wanda Simmons, 42, of Berkeley Springs, was revoked. Simmons was returned to jail on her one-to-five year sentence for delivery of a controlled substance until a bed is available in a drug treatment program.

Lisa M. Weber, 26, of Berkeley Springs was also returned to jail to serve her original sentence of one-to-five years for delivery of a controlled substance after violating the conditions of her probation.
